1. Overview

This Terms of Service Agreement (“Agreement”) outlines the terms and conditions governing the provision of website management services (“Services”, “management”, “website management”) by Cemah Creative LLC (“Provider”, “we”, “us”, “our”) to its clients (“Client”, “you”, “your”). These terms supplement the terms within our Universal Terms of Service Agreement.

2. Restrictions and Limitations

  1. The managed website is purpose built for your business. We reserve the right to decline update requests for website modifications due to a fundamental change in services offered by your business. Fundamental business changes may require a new commitment.
  2. Update requests which require design modifications to more than four pages is considered a redesign and is outside the scope of website management. Redesigns may require a new commitment.
  3. We reserve the right to deny requests that do not adhere to industry best practices, industry user experience (UX) standards, accessibility standards or legal compliance requirements. If a request is denied, we will offer an explanation and any available alternate options.
  4. We cannot implement features to collect, store, or transmit sensitive information. This includes, but not limited to, medical information, Social Security Numbers, TIN/EIN, license numbers, credit card details, banking details, and employment history.
  5. We cannot implement features requiring user authentication using passwords for the purpose of restricting access to information (portals.)
  6. We cannot implement features to facilitate a transaction for money or other compensation (eCommerce), including shopping carts and checkouts. eCommerce features may be added using third-party service integrations.
  7. We cannot guarantee compatibility with third-party services, including future compatibility. If a third-party service integration is made, we have verified compatibility at the time of implementation.
  8. Stock images and videos obtained by us cannot be used outside of the website. Licensing information can be provided for alternate usages.
  9. Over time, the website code may change and require different minimum browser version requirements from when the website was launched. Provider will maintain compatibility with major browser versions from the last two years.

3. Content Update Requests

Your management subscription includes a set number of website content update requests each year. You can request updates anytime by emailing your account representative, who will coordinate the request.

Update requests are defined as:

  • The addition, edit, or removal of text from an existing page
  • The addition, edit, or removal of images or videos from an existing page
  • The adjustment of the layout of an existing page to accommodate new or edited content
  • The addition of a new page using content provided by you
  • The addition or removal of reviews or testimonials
  • The removal of a page

We guarantee content update requests to be completed within 2 business days of the actionable request being made. If the guarantee is not met, you may request a service credit equal to one month of service by emailing support@cemahcreative.com.

4. Non-Content Update Requests

You may use your allotted content update requests for other types of non-content updates. However, these may exceed the standard content update timeline. Your account representative will provide estimated timelines for such requests.

Common supported other requests include:

  • Adding a third-party service script
  • Minor updates to colors, branding and logos
  • Writing content for a new website page
  • Assisting with the addition or removal of user accounts
  • Implementing a new form
  • Providing analysis of analytics
  • Providing data exports
  • Strategy consultation

We will attempt to provide a no-cost solution for non-content update requests. However, large scope of works may be considered a redesign and require a new commitment. You will be informed of any additional costs before work is initiated for approval.

5. Accessibility Statement

We will publish and maintain an accessibility statement page on your website to provide visitors with a means to contact us regarding website accessibility issues. In the event of an accessibility issue notice, we will provide you with the inquiry along with an analysis of the stated issue.

6. Automated Testing

We use automated performance and accessibility monitoring tools to create benchmarks and identify issues. If a performance or accessibility regression is found, we will remedy the issue to meet previous benchmarks at no cost.

7. Software Updates

We will test and implement software updates as they become available and confirmed to be compatible with your website. If an incompatibility is found, we will remedy the issue at no cost to you. The content management system software typically has four major updates per calendar year.

8. Third-Party Service Terms

We may utilize the following third-party services within your website. You agree to the terms and conditions of the following third-party providers:

  1. Adobe Stock – Provides stock photography, illustrations, graphics, videos.
